Terms And Conditions Of Website And Cottages.

1 Booking

1.1 The written booking confirmation that you will receive from us (by post or Email) is our contract with you, and it binds you to the following terms and conditions. (Your statutory rights are not affected by these terms and conditions).

1.2 We reserve the right to amend prices without notice, but once a booking has been confirmed, we guarantee that the price will not increase, unless the booking is amended.

2 Payment

2.1 Can only be accepted by cheque or bank transfer.

2.2 Please make cheques payable to Whitby-cottage.com, bank details are available on request.

2.3 If your booking confirmation is issued within 6 weeks of the commencement of your rental period then payment in full is required.

2.4 If your booking confirmation is issued more than 8 weeks in advance of your commencement of rental period then a deposit of £100.00 is required. The balance is due 8 weeks prior to commencement of the rental period.

2.5 In the event of late or non-payment, we reserve the right to cancel your booking.

3 Cancellation

3.1 Cancellations can only be accepted in writing. We will make every effort to re-let the property for the rental period booked by you.

3.2 If we are successful in re-letting the property we will refund all monies already received (less a £25 administration fee). If we are unsuccessful in re-letting the property no refunds will be given.

4 Transfers

4.1 We will only accept transfers of a booking to an alternative date, subject to availability, under the following conditions:
- That you give us at least 2 weeks notice you wish to transfer.
- That you bear the cost of the difference between the original and revised booking.

5 Your Obligations

5.1 The property will be available from 2:00pm on the day of arrival and must be vacated by 10:00am on your day of departure.

5.2 You must take good care of the property and its contents and leave them in the same condition as you found them on your arrival. You will be liable for any costs arising from any damages, breakages, losses, and any extra cleaning or maintenance costs which are incurred due to your non-compliance with this condition.

5.3 The number of occupants must not exceed that shown on the booking form.

5.4 Please note that smoking is not permitted in the property.

5.5 You are responsible for your own personal belongings during your stay.

5.6 Cars are parked entirely at their owner's risk.

6 Pets

6.1 We regret that pets are not permitted in the property.

7 Insurance

7.1 We recommend you take out insurance to protect you against any losses.

8 Complaints

8.1 If you have any cause for complaint you should bring this to the attention of Whitby-cottage.com on the following contact numbers 01642 458808, 01642 306065 or 07939 130932 as soon as possible. We will endeavour to find a satisfactory solution. In any event you should register your detailed complaint in writing within 14 days of your return from holiday.

9 Right of Entry

9.1 We reserve the right for Staff to enter the property without permission at reasonable times to undertake their duties or inspect and/or carry out any repairs, maintenance in the property.

10 Liability

10.1 We do not exclude our liability for death or personal injury caused by our negligence.

10.2 We shall not be liable for :
a) any loss or damage caused directly or indirectly by circumstances or events beyond our control
b) any indirect or consequential losses
c) any loss of profit or other business losses

10.3 Our total liability for any tangible damage to your property by our negligence will not exceed £10,000.

10.4 Our liability other than in respect of those detailed in condition 10.1 and 10.3 will be limited to the amount you paid us for the rental of the property.

11 Law

11.1 The contract between you and us is subject to English Law.
